Welcome to MyCallsAI. These Terms and Conditions govern your access to and use of our platform, including the AI voice receptionist, chat engine, and related communication services. By creating an account or using any part of the Services, you agree to be legally bound by these Terms.
1. Agreement to Terms
These Terms constitute a legally binding agreement between you ("Customer") and MyCallsAI ("we", "us", "our"). By creating an account, subscribing to a plan, or otherwise using any part of the Services, you confirm that you are authorized to bind your organization to these Terms. If you do not agree, you must not use the Services.
2. Our Services
MyCallsAI provides AI-powered communication tools that help small businesses never miss a call, including:
We reserve the right to modify, suspend, or discontinue any feature of the Services at any time with reasonable notice.
3. Payment & Subscription Tiers
MyCallsAI offers three subscription tiers. All prices are in Canadian dollars (CAD) and billed monthly in advance. Your subscription renews automatically on your billing date unless cancelled prior to renewal.
Includes 100 AI minutes per month across all services.
Includes 300 AI minutes per month across all services.
Includes 750 AI minutes per month across all services.
Unused minutes do not carry over to the next billing cycle. Payments are processed securely via Stripe. By subscribing, you authorize MyCallsAI to charge your saved payment method on each renewal date.
4. Usage & Overage Costs
What counts toward your monthly minutes?
Your plan minutes are a shared pool consumed by all AI-powered activity on your account:
- AI voice agent talk time — every second the AI is live on a call
- Chat engine conversations — AI-handled web chat or in-app messaging sessions
- SMS / text messages — inbound and outbound AI-managed text messages
- Call transcripts & summaries — automated generation after each call
Usage is measured in 60-second increments. Partial minutes are rounded up to the next full minute.
Important: Overage Billing
Once your monthly minute allotment is exhausted, all further usage is billed at the overage rate below for the remainder of your current billing cycle. Overage charges accumulate and are applied automatically to your saved payment method at the end of your billing cycle. A new full allotment is restored when your subscription renews.
All minutes used beyond your plan allotment are billed at $0.60 CAD per minute, applied across all service types (voice, chat, SMS, transcripts).
The 7-day Free Trial is capped at 10 minutes of total AI usage. Once 10 minutes are consumed, the trial concludes and you must subscribe to a paid tier to continue. No overage charges apply during the trial — service simply stops when the cap is reached.
You may review your usage at any time in your account dashboard. Disputes regarding charges must be raised within 30 days of the invoice date by contacting [email protected].
5. Cancellation & Refunds
You may cancel your subscription at any time from your account dashboard. Cancellation takes effect at the end of your current billing period — you retain access to the Services until that date. We do not provide prorated refunds for unused time within a billing cycle.
Overage charges that have already accrued at the time of cancellation remain due and will be charged at the end of the billing cycle.
6. Acceptable Use
You agree not to use the Services to transmit spam, conduct fraud, harass callers, violate any applicable law, or reverse-engineer any part of our platform. MyCallsAI reserves the right to suspend or terminate accounts found in violation of this policy without refund.
7. Limitation of Liability
MyCallsAI provides automated AI solutions on an "as is" basis. We are not liable for any missed calls, scheduling errors, AI misinterpretations, or resulting loss of revenue or business opportunities. The Services are not guaranteed to be uninterrupted or error-free.
Our total aggregate liability to you shall not exceed the total subscription fees paid by you in the one calendar month immediately preceding the event giving rise to the claim.
8. Call Recording & Compliance
Your Responsibility: You are solely responsible for ensuring that your use of AI call handling and recording complies with all applicable laws in your jurisdiction, including but not limited to PIPEDA (Canada), CASL (for SMS), and any applicable provincial recording consent laws. This includes notifying callers that their call is being handled and/or recorded by an AI system.
MyCallsAI provides the technology platform only. We do not provide legal advice. You should consult a qualified attorney to ensure your deployment is compliant.
9. Privacy & Data
We collect and process data as described in our Privacy Policy. Call transcripts, summaries, and caller data are stored securely and accessible only to authorized users on your account. You retain ownership of your business data. We do not sell your data to third parties.
10. Governing Law
These Terms are governed by the laws of the Province of British Columbia, Canada, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the courts of British Columbia.
17. Eligibility & Authority to Use the Services
17.1 Minimum Age Requirement
The Services are intended solely for use by individuals who are 18 years of age or older. By creating an account, subscribing to a plan, or otherwise using any part of the Services, you represent and warrant that you are at least 18 years of age.
MyCallsAI does not knowingly permit individuals under the age of 18 to create accounts or use the Services. If we become aware that an account has been created by or on behalf of a person under 18, we reserve the right to:
- Immediately suspend or terminate that account without notice
- Cancel any active subscription associated with that account
- Issue no refund of any fees paid in connection with that account
If you believe a minor has created an account on the platform, please notify us immediately at [email protected].
17.2 Business Use Only
The Services are designed and intended exclusively for business and commercial use. MyCallsAI is not a consumer product. By using the Services you represent and warrant that:
- (a) You are using the Services for legitimate business or commercial purposes only, and not for personal, household, or domestic use
- (b) You are operating as a sole proprietor, freelancer, corporation, partnership, LLC, or other legally recognized business entity, or as an authorized representative of any of the above
- (c) Your use of the Services is consistent with all applicable laws governing the operation of your business in your jurisdiction
17.3 Authority to Bind Your Organization
If you are creating an account or accepting these Terms on behalf of a company, organization, employer, or other legal entity, you represent and warrant that:
- (a) You have the full legal authority to bind that entity to these Terms
- (b) You are an officer, director, owner, or authorized employee of that entity, or have been expressly authorized in writing to accept these Terms on its behalf
- (c) The entity you represent is duly incorporated, registered, or otherwise legally recognized under the laws of its jurisdiction of formation
- (d) These Terms, once accepted by you, constitute a legally binding obligation of that entity
If you do not have authority to bind your organization, you must not accept these Terms or use the Services on that organization's behalf. MyCallsAI is not responsible for any unauthorized acceptance of these Terms by a person lacking the requisite authority.
17.4 Geographic Eligibility
The Services are operated from and governed by the laws of British Columbia, Canada. You may access and use the Services from any jurisdiction, subject to the following:
- (a) You are solely responsible for ensuring that your use of the Services is lawful in your jurisdiction, including compliance with any local licensing, registration, or regulatory requirements applicable to your business
- (b) MyCallsAI makes no representation that the Services are appropriate, compliant, or available for use in every jurisdiction
- (c) If you are in a jurisdiction where AI-powered voice agents, automated SMS, or call recording is restricted or prohibited, you must not use the relevant features without first obtaining appropriate legal clearance
- (d) MyCallsAI reserves the right to restrict access from specific jurisdictions at any time, with or without notice, where required by applicable law or internal policy
17.5 Account Registration Accuracy
By creating an account you represent and warrant that:
- (a) All registration information — including your name, business name, email address, phone number, and billing information — is true, accurate, current, and complete
- (b) You will promptly update your account information if any of it changes
- (c) You will not create an account using a false identity, fictitious business name, or another person's information
- (d) You will not create multiple accounts for the same business or individual to circumvent plan limits, trial restrictions, or any suspension imposed by MyCallsAI
- (e) You will not share your account credentials with any person outside your organization
MyCallsAI reserves the right to verify the accuracy of registration information at any time and to suspend or terminate accounts where false or misleading information has been provided.
17.6 Prohibited Persons & Entities
You may not use the Services if you are:
- (a) Located in, operating from, or a resident or national of a country subject to Canadian or international sanctions, including any country designated by Global Affairs Canada or the UN Security Council
- (b) Listed on any government sanctions list, including Canada's Consolidated Canadian Autonomous Sanctions List or the US OFAC Specially Designated Nationals list
- (c) Previously suspended or terminated by MyCallsAI for violation of these Terms, unless MyCallsAI has expressly reinstated your eligibility in writing
- (d) Prohibited from receiving or using the Services under applicable law for any other reason
By using the Services, you represent and warrant that none of the above applies to you or the entity on whose behalf you are using the Services.
17.7 Consequences of Misrepresentation
If MyCallsAI determines that you have misrepresented your eligibility, authority, age, identity, or any other material fact, MyCallsAI reserves the right to:
- (a) Immediately suspend or terminate your account without notice or refund
- (b) Void any contractual obligations MyCallsAI may have to you under these Terms, to the extent permitted by applicable law
- (c) Pursue legal remedies available under applicable law, including claims for damages arising from the misrepresentation
- (d) Report the misrepresentation to relevant regulatory or law enforcement authorities where required or appropriate
17.8 No Services to Competing Platforms
You may not use the Services if you are an employee, contractor, officer, or director of a company that directly competes with MyCallsAI in the AI voice agent or automated business communication market, and your purpose in using the Services is to:
- Evaluate or benchmark the platform for competitive intelligence purposes
- Reverse engineer or replicate any feature, workflow, or methodology of the Services
- Solicit MyCallsAI's customers or business partners
MyCallsAI reserves the right to terminate accounts where it has reasonable grounds to believe this provision has been violated.
